These conditions (the "Conditions") apply exclusively to the relationship between HANKO S.à r.l. ("HANKO", "HANKO Luxembourg" or the "Company") and the originator of the order (the "Customer") ) and govern their relationships with respect to any product orders through the www.hanko.lu site (the "Site"). The site is intended for professionals (companies, administrations, liberal professions, craftsmen, traders, associations and communities) and individuals.
1. General
These Conditions are deemed to be known to any Customer placing an order regardless of the mode, and is worth the Customer's unreserved acceptance of the said Conditions. Therefore, any contrary clause cannot be opposed to HANKO insofar as it has been formally accepted by the Company.
HANKO reserves the right to modify these Terms at any time.
2) Price
The prices indicated on the site can be modified at any time. The prices invoiced are those in force at the time of the order. The prices indicated are excluding taxes. Prices are exclusive of shipping costs. The site automatically calculates shipping costs based on the items in the cart and their destination.
3) Delivery / reception
Supplies are usually shipped within 24 hours by courier. Any complaint for non-compliance must be sent as soon as possible to HANKO by email to the address info@hanko.lu. Late complaints, beyond 48 hours, cannot be taken into account and the responsibility of the Customer is then only and fully engaged. The transfer of risks takes place from HANKO.
The Company reserves the right to make any modification to the products at any time that the Company deems useful. Product insurance is the responsibility of the Customer upon delivery.
4) Availability of products / Out of stock
Any offer from HANKO will only be valid while stocks last. In the event of a possible stock shortage affecting a Customer's order and if the restocking exceeds 3 working days, HANKO will indicate to this Customer a new delivery time. The Customer may cancel his order and be reimbursed if necessary.
In the event of the unavailability of a product, HANKO may suggest that the Customer deliver another product of quality and price equivalent to the first. The Company reserves the right to cancel all or part of the orders paid by its Customers in the event of default by its suppliers by reimbursing any sum already paid by the Customer and relating to the orders concerned.
5) Special fabrications, off-site products
Any order concerning special productions implies acceptance by the Customers of the quantity and dimension tolerances in use in the profession.
The same is true for any order of non-catalogue products, which must respect the minimum sales unit imposed by the manufacturer or importer.
(Failing this, it will be rounded up to this quantity.)
6) Payment
By credit card when placing the order or by bank transfer. If the Customer opts for bank transfer, the order will only be dispatched after receipt of payment, which generally takes place within one working day for transfers between banks located in the Grand Duchy of Luxembourg.
7) Satisfied or refunded
All products on the site, unless otherwise indicated, benefit from the "Satisfied or refunded" clause and apart from any problems of typing errors made by the author of the order under which the Customer can be reimbursed or exchanged the (s) product(s) delivered according to the methods described in article 8 Return conditions below for 7 days from the date of receipt of the product. HANKO Sàrl however reserves the right to refuse the exchange or refund of any product ordered on the basis of an estimate.
8) Return conditions
To proceed with a return, it is necessary to obtain our prior authorization, by sending an email to info@hanko.lu who will will provide information on the procedure to be followed. For an order cancellation, the amount of the item excluding shipping costs will be refunded to you by bank transfer after receipt of the product. Please also specify the reason for the return.
For an exchange, the product must be returned at your expense. The products are only taken back complete, in perfect condition and in their original packaging, the consumables delivered unopened, the packaging intact and the content compliant. Beyond the deadlines indicated in article 7 above, the products delivered will be deemed to comply with the Customer's order and accepted in full by him.
In the event of a text error on the rubber plate, the Customer may order a new plate which will replace the one containing the error. In any case, the manufacturing costs of the plate containing the error cannot be reimbursed.
9) Warranties
HANKO warrants only that the products shipped are free from defects in workmanship and materials. HANKO's only obligation under this warranty shall be, at its option, to repair, replace or credit the Customer's account according to its possibilities and no compensation may be claimed by the Customer due to a delay in delivery of replaced or repaired products.
The warranty period is limited to a period of 1 year from the date of shipment of the products. The amount of the guarantee cannot exceed the amount of the order placed by the Customer. Defective products must be returned to HANKO, the return costs remain your responsibility and they will be examined in order to provide proof of their non-compliance with manufacturing or material standards and that this non-compliance has no none were caused by accident, misuse, negligence, modification, misuse, improper repair or testing on the part of the Customer.
Any replacement of a product recognized as defective does not give rise to the extension of the guarantee set out above.
HANKO's warranty for the products is strictly limited to the provisions herein, to the exclusion of all other express, implied, statutory or other warranties.
10) Applicable law and competent jurisdiction
For all disputes relating to the performance of the contract between HANKO and the Customer, the Commercial Court of Luxembourg will have sole jurisdiction. These Conditions, as well as any contract entered into by the Company and subject to them, will be governed by and governed by Luxembourg law.
11) Miscellaneous Provisions
The photos and graphics on the site are only indicative and do not bind the Company, just as the Company cannot be held responsible for typographical errors. All the texts and images presented on the site, for the whole world, are reserved under copyright and intellectual property, their reproduction, even partial, is prohibited.
The trademarks mentioned on the site are the property of the companies concerned. The characteristics of the products presented can be modified according to the technical evolution and the evolution of the offer of the suppliers of HANKO
The principal undertakes to hold the reproduction rights of the brand, logo, image, signature, or other, and this in compliance with the conditions of validity provided for this purpose by the code of industrial property, to act disregard of these rules would constitute the offense of counterfeiting. The Company will ask to produce all the necessary authorizations for all official or other documents, if this proves necessary, before the manufacture of the stamp.
12) Computing and Freedoms
HANKO is committed to protecting your personal data. All personal data concerning you that we have collected is treated with the strictest confidentiality, in accordance with the provisions of our personal data protection policy. When you order, we only ask you for the information that is essential to ensure the quality of our services and the processing of your order. We do not sell, trade or rent this information to third parties. You have the right to access and rectify the data concerning you. To exercise this right, you can modify the information concerning you at any time using your username and password by accessing your account or by sending an email to info@hanko.lu.
By adhering to these Terms, you acknowledge that you have read our personal data protection policy and consent to our collection and use of this data.
